These Terms of Service ("Terms") constitute a legally binding agreement between you and Famroo LLC, a Florida limited liability company doing business as Famroo ("Famroo," "we," "us," or "our"), regarding your use of the Famroo website, mobile application, and related services (collectively, the "Service").

By accessing or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our Service.

2. Service Description

Famroo is a digital platform designed to help families manage household chores and rewards through an engaging, gamified system. Our Service includes:

• Digital chore charts and task management tools
• Star-based reward systems and achievement tracking
• Family account management with parent and child profiles
• Printable chart templates and certificates
• Digital rewards store and custom reward creation
• Progress tracking and reporting features
• Email notifications and reminders

3. Eligibility and Age Requirements

To use our Service, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into these Terms
• Reside in North America (United States, Canada, or Mexico)
• Provide accurate and complete information during registration

Children's Use

While our Service is designed for families with children, only adults (18+) may create accounts and agree to these Terms. Parents or legal guardians are responsible for supervising their children's use of the Service and for all activities that occur under their account.

4. User Accounts and Security

Account Creation

To access certain features of our Service, you must create an account. You agree to:

Account Termination

7. Payment Terms and Billing

Subscription Plans

Famroo offers both free and paid subscription plans. Paid plans provide access to additional features and are billed on a recurring basis.

Payment Processing

Payments are processed through our third-party payment processor, Authorize.Net. We do not store your payment information on our servers. By providing payment information, you authorize us to charge the applicable fees to your chosen payment method.

Billing and Renewal

• Subscriptions automatically renew unless cancelled
• You will be charged at the beginning of each billing period
• Subscription fees are non-refundable except as required by law
• We may change subscription prices with 30 days' notice
• Failed payments may result in service suspension

Cancellation

You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of your current billing period.

8. User Content and Intellectual Property

Your Content

You retain ownership of any content you create or upload to the Service ("User Content"), including custom rewards, chore descriptions, and family photos. By using our Service, you grant us a limited, non-exclusive license to use, display, and distribute your User Content solely for the purpose of providing the Service.

Our Content

The Service, including its design, features, text, graphics, logos, and software, is owned by Famroo and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our content without written permission.

Third-Party Content

Our Service may include content from third parties. We do not endorse or assume responsibility for third-party content, and such content is subject to the terms and conditions of its respective owners.

9. Termination

Termination by You

You may terminate your account at any time by contacting us at admin@famroo.com. Upon termination, your access to the Service will cease, but these Terms will continue to apply to your prior use of the Service.

Termination by Us

We may suspend or terminate your access to the Service immediately, without prior notice, for any reason, including:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of fees
• Inactivity for extended periods
• At our sole discretion

Effect of Termination

Upon termination, you will lose access to your account and all associated data. We are not obligated to retain or provide copies of your data after termination.

10. Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING:

• MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
• THAT ANY DEFECTS WILL BE CORRECTED
• THE ACCURACY, RELIABILITY, OR COMPLETENESS OF CONTENT

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAMROO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

• Loss of profits, data, or use
• Business interruption
• Personal injury or property damage
• Loss of privacy or security breaches

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless Famroo, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content

13. Dispute Resolution

Informal Resolution

Before pursuing formal dispute resolution, we encourage you to contact us at admin@famroo.com to discuss any concerns. We commit to working with you in good faith to resolve disputes.

Mediation

If informal resolution is unsuccessful, any disputes arising from these Terms or your use of the Service shall be resolved through binding mediation in accordance with the rules of the American Arbitration Association. Mediation shall take place in Pasco County, Florida.

Class Action Waiver

You agree that any dispute resolution proceeding will be conducted only on an individual basis and not as part of a class, consolidated, or representative action.

14. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any legal action or proceeding shall be brought exclusively in the courts of Pasco County, Florida.

15. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Famroo regarding the Service.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

Assignment

You may not assign these Terms without our written consent. We may assign these Terms without restriction.

Force Majeure

We will not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, or government actions.

16. Updates to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by:

• Posting updated Terms on our website
• Sending email notification to registered users
• Displaying a notice within the Service

Changes become effective 30 days after notice, except for changes required by law, which may take effect immediately.
